NearFox.com and its subsidiaries and affiliates (collectively ‘NearFox’) provide you access to a variety of services, including, but not limited to, the NearFox website, NearFox’s mobile application and all products and services available through our website (collectively ‘Services’). These TERMS OF USE (TERMS) govern access to and use of NearFox.com’s Services. This website is owned and operated by M/s Zip Infosolutions Private Limited, a company incorporated under the Indian Companies Act, 2013. The term ‘NearFox’ or ‘us’ or ‘we’ or ‘our’ or ‘company’ refers to the owners, managers and employees of NearFox. The term ‘you’ refers to the user or viewer of NearFox’s Services.

These TERMS apply to your use of NearFox’s Services. Please read them carefully for, by using NearFox Services, you agree to be bound by them.

What you see on our Services may be protected by one or more laws regarding intellectual property.

NearFox offers news and information on different topics pertaining to your locality. These are obtained from multiple sources, including curation, our field resources and users. We reserve the right to remove, edit, modify or unpublish any content on our platforms without any notice. NearFox adheres to fair use policy for content that it receives from other sources.
NearFox is not responsible for any, loss financial or personal, that you may incur as a result of the unauthorised use of your account or account information. We do not hold any liability for the accuracy, inaccuracy, completeness, incompleteness, alteration, modification or timeliness of the content that is available on our platform. NearFox cannot be held responsible for the products and services provided by advertisers or their partners on our platform.
You promise to use the Service only for lawful purposes and to not violate the rights of third parties. Our Community Guidelines, which are part of these TERMS, contain more information about the acceptable and unacceptable uses of the Service. We have zero tolerance for content that doesn’t comply with our community guidelines. Any such unacceptable use, including posting or collecting content that is obscene, pornographic, gory, illegal, threatening or harassing, excessively violent or promoting the harm of self or others, may result in immediate termination of your account and suspension of Service access in the future.

You can post your own content on NearFox, including articles, photos, questions, comments and other content. By posting such content, you give us permission to use it to do what we reasonably believe necessary to provide our Service both now and in the future, including storing, displaying, reproducing and distributing your content. This might also include promoting your content with partner companies or services for broader broadcast, distribution or publication via NearFox.
You’re responsible for the content you publish through NearFox and assume all risk associated with it, including anyone else’s reliance on its accuracy or legal claims that might stem from publication. By posting content on NearFox, you represent that you have the necessary rights to publish that material, and that doing so doesn’t conflict with any licences you may have granted to others.
We don’t always pre-screen everyone’s content. However, we have the right to review, edit, modify and remove any content on NearFox for any reason. We assume no liability for anything that you or anyone else publishes through NearFox.
NearFox also contains links to websites, services, content and advertisements that we don’t own or control. We don’t necessarily endorse or assume responsibility for that stuff, either.
NearFox may display advertisements along with your content in future. We are not bound to share the revenues earned through such advertisements with you.

Our Privacy Policy explains our collection and use of information on the Service, including information you may consider personal. You consent to the information practices described in that policy as it may be updated from time to time.

We take the security of NearFox very seriously. We use reasonable practices to protect the security of your account and the data associated with it, but we can’t guarantee that someone won’t be able to defeat our security measures. Please let us know immediately if you discover any compromise of your account.
We always keep a lookout for security loopholes in NearFox. If you discover a vulnerability in our service, we would be grateful if you let us know immediately.

As per Indian laws, the user(s) must be at least 18 years of age to be eligible to use our services. In case you are from outside India and above the age of 12, kindly use NearFox under parental guidance.

NearFox respects the intellectual property rights of others and expects users of the Services to do the same. We will respond to notices of alleged copyright infringement that comply with applicable law and are properly provided to us. If you believe that your content has been copied in a way that constitutes copyright infringement, please send us an email on [email protected] with your contact information.
We reserve the right to remove content alleged to be infringing or otherwise illegal without prior notice and at our sole discretion. In appropriate circumstances, NearFox will also terminate a user’s account if the user is deemed to be a repeat infringer.

NearFox is a dynamic product, always evolving and (hopefully) getting better. As a result, we may change, eliminate or restrict access to our products or any part of our service at any time, for any reason, with or without advance notice. And we may do so with respect to one, some or all of our users.

NearFox is provided “as is” without any warranties, express or implied.
NearFox disclaims all warranties and conditions of merchantability, fitness for a particular purpose and non-infringement.

To the fullest extent allowed by law, NearFox shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill or other intangible losses resulting from: (A) your access to, use of, inability to access or inability to use NearFox; (B) any third-party conduct or content on NearFox, including any defamatory, offensive or illegal conduct of third parties; or (C) any unauthorised access, use or alteration of your content.

If you become disgruntled with NearFox for any reason, we’d like the opportunity to work out our differences informally. We strongly encourage you to contact us at [email protected] and we’ll do our best to resolve the dispute in good faith.

The terms of this agreement are exclusively based on and subject to Indian law. You hereby consent to the exclusive jurisdiction and venue of courts in Mumbai, India in all disputes arising out of or relating to the use of NearFox Services. The use of Services is unauthorised in any jurisdiction that does not give effect to all provisions of these TERMS, including without limitation this paragraph.

These TERMS and our Privacy Policy constitute the entire agreement between you and NearFox. If any provision of these TERMS is found to be unenforceable, the remaining provisions will continue to be in full force and effect.

These TERMS may be modified from time to time. You agree to accept any changes or revisions to these TERMS by continuing to use NearFox.

NearFox is a community of people who love to share and discover inspired and inspiring content. If you stick to the following recommendations, we’ll all have a great time.
Consume. Be yourself. Share what you love and comment earnestly on others’ work. Quality interactions help our ecosystem thrive and strengthen our community.
Comment. Don’t be a jerk. We have zero tolerance for comments that are racist, hateful, threatening or disrespectful, and reserve the right to remove comments that:

– Contain swear words or other language likely to offend. – Break the law or condone or encourage unlawful activity. (This includes breach of copyright, including plagiarism, defamation and contempt of court.)
– Advertise products or services for profit or gain. – Are seen to impersonate someone else. – Include personal information such as phone numbers, postal or email addresses. – Contain links to other websites. – Are considered spam.

NearFox is not a place to consume or curate adult or illegal content. Just don’t do it. Accounts that persistently showcase inappropriate content will be closed and may face further disciplinary action. Other don’ts:
Don’t share illegal or prohibited content such as child pornography, encouragement of illegal acts or infringing intellectual property. We will respond to notices of alleged copyright infringement as set forth in our TERMS. Don’t share overly violent or dangerous content, including hate speech or abuse of any kind such as the promotion of self-mutilation, eating disorders or drug abuse. Don’t share content that qualifies as phishing or spam or that might abuse or present a security threat to NearFox. Don’t share pornography, graphic sexual content or nudity intended to titillate. Don’t threaten, stalk, bully or harass others. Credible real-world threats will be taken seriously and may be escalated to the police. Don’t misrepresent your affiliation with any person or entity. We reserve the right to reclaim your account name if you are impersonating a real person or brand. Don’t invade the privacy or misuse the personal identity of someone else. This includes posting someone’s real-world identity, personal details or contact information without his or her permission.

Here we will try our best to explain you in simple terms what information we collect about you, what we use it for, and the few situations in which we share it with others. Please read this privacy policy carefully. It applies to all interactions you have with NearFox’s products and Services.

You don’t need to create an account to see the content available on our services. However, if you want to contribute and interact, we will ask you to create an account where you can sign in through an account you already have with another service, such as Google or Facebook.
Your user profile helps you customise your account and submit your content to be viewed by other NearFox users. In future you may be able to connect to other NearFox users or other users can connect with you. Your profile may automatically include your name and username. To help you connect with other NearFox users and to personalise your NearFox experience, we may ask for additional information, including your name, email id, contacts, location or a list of the apps on your mobile device.
We receive some other information automatically when you use NearFox. This includes data such as your device, software, operating system, your IP address and the date and time of each request you make to NearFox. To make your NearFox experience better, we collect information about how you view and contribute content through NearFox.
If you want to email something you see on NearFox to a friend who isn’t already a NearFox account holder, we may keep their email address for the purpose of sending such email and improving our services. Recipients may contact us at [email protected] to request that we remove this information from our database.

A big part of NearFox is sharing content you find interesting. That’s why your NearFox profile, the comments you post and the content you contribute are all public. Aside from that, we use your information to keep NearFox running, better understand how you use our service, customise your experience, prevent abuse and improve NearFox. We share your personally identifiable information only under these circumstances:
• With your consent, after letting you know what information will be shared, and with whom.
• If we believe it’s reasonably necessary to comply with a law, regulation or legal process. If we’re going to release your information, our policy is to provide you with reasonable advance notice under the circumstances unless we’re prohibited from doing so by law or court order. We may disclose your information without giving you prior notice if we believe it’s necessary to prevent imminent and serious bodily harm to a person. Nothing in this privacy policy is intended to limit any legal objections or defences you might have to efforts by third parties to compel disclosure of your information, including legal orders from the government.
• To third parties helping us offer and improve our service, such as those providing NearFox certain technical tools and analytics that help us understand how people use NearFox so we can make it better.
• If we sell, transfer or otherwise share some or all of our assets, including the information identified in this privacy policy, in connection with a merger and acquisition. We may also share non-personally identifiable, non-aggregate information with companies that help us improve our products and services, (such as research companies and analytics providers). As with your personally identifiable information, we require that such companies observe the limitations in this privacy policy.
• We may disclose aggregate information about how our users use NearFox in a manner doesn’t identify you individually.

NearFox grants you permission to only access and make personal use of the Services and you agree not to, directly or indirectly download or modify/alter/change/amend/vary/transform/revise/translate/publish or otherwise disseminate any content on NearFox Services, or any portion of it; or delete or fail to display any promotional taglines included in the Services either directly or indirectly, except with the express consent of NearFox.
However, you may print or download extracts from these pages for your personal/individual, non-commercial use only. You must not retain any copies of these pages saved to disk or to any other storage medium except for the purposes of using the same for subsequent viewing purposes or to print extracts for personal/individual use.

Some publishers or other third-party services that we partner with may use cookies, web beacons or other technologies to keep track of your Internet activity. Please note that this privacy policy explains NearFox’s policies only, and doesn’t cover the practices of other services.
Some browsers make it possible for you to signal that you don’t want your Internet browsing activity to be tracked. The Internet community hasn’t reached a consensus on how to best honour these signals, so we don’t respond to Do-Not-Track requests at this time.

As NearFox continues to develop, we may decide to revise this privacy policy from time to time. The most current version will govern our use of your information. You agree to accept any changes or revisions to this privacy policy by continuing to use NearFox.
For an event buyer, price is mentioned on respective event page. For event organisers, we have customised pricing according to the services rendered by us.

NearFox uses recognized, ethical and apporved Payment Gateway Service provider for processing all payments. These payments are processed safely using payment gateway providers SSL access. We don’t store your payment information suc as credit card number, bank account number, pin, etc with us. Your payment request is handled by our payment gateway provider and your designated bank for a specific online payment.

For an event buyer, we curently don’t handle refund on behalf of our event organizers. But in case your payment resulted unsuccessful ticket buying, we support you by providing information and forward your request to payment gateway providers.
